morning news. good morning. thank you for waking up with us. it's monday november 8th i'm pam cook. >> and i'm dave clark. let's check your weather and traffic. >> the system from yesterday pretty good rain. two inches of rain. things will calming down. the wind has picked up. it will be a cool, breezy day. a lot of 40s right knew. we'll end up with 50s and 60s. let's get to the news with dave and pam. >> it's 5:00. police in oakland are investigating an overnight shooting that ended with a car crash. police say the victim plowed into a house on high street and koa vert. several homes had to be evacuated because of a gas leak. kraig debro is there right now. >> reporter: good morning. that particular aspect of the story is over. they were able to cap that

leak. however ten people maybe ten home in the area had to be evacuated because of that gas leak. that bust down there that ac transit bus a lot of people were put on that bus. back to the top story here. see the driver the vehicle in front of this house. this is the vehicle that crashed in front of this house at 2:00 a.m. this morning. police say the car may have been parked along the street and then they don't know what happened after that. they think maybe the person was shot before he started to drive away in an attempt to escape or he could have been shot when he crashed into the house. we do know the person is in a hospital right now talking to a detective. the person was in critical condition. it might be worse than that. the other person is on life support we're hearing and that is as soon as the machine would be taken away that person would not survive. witnesses detectives wouldn't

talk about. right now they are trying to develop that at this hour. they don't have too much information. the car is registered to a person that does not reside in oakland but they don't know if that person was the same person that was behind the wheel of the car. right now i will talk to residents to see what they heard or saw early this morning. reporting in oakland kraig debro. the gymnasium at claire month middle school will likely be off limits. firefighters rushed to the school shortly before 2:00 a.m.. the fire was contained to the roof of the schools gym but generated a lot of smoke. the gym has a lot of water damage. firefighters say they suspect ann electrical problem may be to blame. >> police arrested 18-year-old tyler bar consider early saturday morning after a brief

foot chase. officers recovered two computers and a monitor. if you have any information please call vacaville police. a marine firefighter is being called a hero. luckily an off duty firefighter was surfing nearby. he convinced them to get off that boat and swim to safer waters. those boaters were treated for mild hyper thermae. former bart police officer johannes mehserle remains in county jail. on friday a judge sentenced him to two years in prison. ktvu claudine wong is joining us live now. she's in the newsroom with the latest on what is next. good morning. >> reporter: good morning.

we johannes mehserle sentence. a bail hearing has been scheduled. it's still weighing its options. with his two year sentence it is likely the bart officer will spend seven more months behind bars. that's assuming he will get even more credit for good behavior. his bail is set for two weeks for now. in fact he says he will not rest until mehserle is out and even if that battle is not won it's still unclear if meze ily will serve out his sentence in state prison or county jail. for now he does remain behind bars in the los angeles county jail. and we may not have seen the last of protest over the sentence. 152 protestors were arrested after demonstrators. they were charged with unlawful

assembly and protestors are watching criticism about the police response. the coalition is one of the groups claiming police milterrized downtown and created fear and intimidation. the police response ignite unnecessary confrontation. some protestors say more protests are still being planned. the family of oscar grant is still trying to get the court to look at this case. there are still more civil suits pending. suitgrants mother and by grants friends that were with him when the shooting happened. while the sentencing of johannes mehserle is over and one big chapter seems to have ended this story is far from over. we'll continue to follow it. live in the newsroom claudine wong. >> thank you. we have continuing coverage of the mehserle case on our channel 2 website ktvu.com just

go to it. click on the tab near the home page. right now is 5:05 i want to check in with sal with a look at traffic. morning. >> morning to you. traffic is okay. i want to go to the live pictures and the traffic here own highway 80 westbound looks pretty good. no major problems. as a matter of fact we're off to a nice start at the bay bridge. that is gone now. they have actually picked all of it up. they were doing that 10-15 minutes ago. your drive across from san francisco to oakland which a lot of people do is clear for you. especially near the toll plaza. you're looking at a live picture of 280 northbound. it looks pretty good. it should be a nice drive for the next hour or two. there are no major problem there is. 5:06 let's go to steve. thank you.

a very good morning. not a bad system left some decent totals. 1-2 inches. i will show you the satellite. the visible satellite. everything has moved off to the east. that is drying air coming in. everything is coming out of the northwest. breezy cool day. system held together. things are much calmer down there. you can see right down that's a fast jet stream. it will be cool today and breezy with upper's -- upper 50s and very low 60s. 40 right now. if it wasn't for any breeze it would be colder than this. okay chilly. not cold, cold. 27 up in tahoe. 37 in reno. 37 in ukiah. 40s and 50s down to southern california. high pressure system is trying to build in there is one more

welcome back to the morning news. just a short while ago president obama addressed indias parliament. he's declaring the u.s. india relationships is the defining partner of the 21st century. alison burns is in our newsroom. good morning to you. >> reporter: good morning to you, pam. this is the president's last day of the three-day trip to india. he's passionately promoting india as a rising economic power and he says the u.s. supports it. let's take a look here at the president's arrival at india's parliament building an hour and

a half ago. he says the u.s.-india relationship is stronger, deeper, and broader than ever before and addressed the concerns of many in the u.s. that india is stealing jobs by saying trade is a two way street and it's a win-win. >> it's no coincidence that india is my first stop to a visit to asia or this has been my longest trip to another country since becoming president. for in asia and around the world, india is not simply emerging it has emerged. >> reporter: they will attend a dinner in their honor. we'll have live coverage. 5:12. very disturbing story this morning. a french newspaper reports that al qaeda and iraq tried to blow

up planes headed here to the united states by surgically planting bombs inside the dogs. american soldiers working in the airport cargo area noticed the dogs died and soon they found there were bombs inside of them. there is a new controversy over california lethal injection procedure for carrying out the death penalty. it currently has enough of the lethal injection drugs for up to four executions. they are questioning where the state got those drugs. that's because a judge called off a scheduled execution because of the state supply of thee that injection drugs expired. a spokeswoman wouldn't say where the state found the current supply of the drugs. robert gates is urging

congress to repeal the don't ask don't tell policy. gate says the current congress should take up the new issue before the new members takes their seats in january. they have approved lifting the ban but it was blocked in the senate. we are still tracking results this morning and several closely watched undecided races. first off jeremy mcmerney seems to be helding on to his lead. he has 47.7% of the vote. only 421 votes separate them. in the oakland mayors race they will release the final tally of ranked choice voting. the latest numbers released friday afternoon put council woman gene quan in the lead.

while perada had 49%. and there is still no declared winner in the race for state attorney general. the latest numbers show los angeles county district attorney steve cooley pulling ahead of harris. cooley has 46.1 pest of the vote. they say this race may remain too close to call until the end of the race. 5:15 a new acting police chief is in charge in san jose. chris moore is in the top spot right now after former police chief rob davis retired. moore grew up in marin county. he's been on the police force since 1982. city manager has been holding public hearing about picking a new police chief. supporters of legalizing marijuana say they are already gearing up for a come back

ballot proposition. even though proposition 19 failed in last tuesdays election. supporters say the fact the vote was so close 54% to 46% means it's only a matter of when not if marijuana will be legalized. they say they will use what they learn #ed in this election cycle to put together a better campaign. . >> it has been debeated for years -- it has been debated for years and now plans to build a smart commuters train is now under way. to builds first part of the train between the civic center in synura fold and railroad square in santa rosa. the rail line was supposed to go from the ferry to clover dale but the railroad says the poor economy has reduced the

sales tax revenue. the first train segment is expected to finish in 2014. a lot of people looking forward to that. 5:16 is the time. we understand there is a crash on the peninsula. let's go to sal. >> that is right. southbound 101. this accident occurred a few minutes ago. supposedly has the two left lanes closed. i want you to let you know southbound 101 will be slowing down. approaching whipple avenue. southbound 101 before the whipple avenue is a crash blocking the two left lanes. we have a better alternate route for you and that would be interstate 280. southbound 101 crash. northbound 101 may be effected because of rubber neckers. westbound 24 looks pretty good. and here at the toll plaza it is a light commute so far. now 5:17 let's go to steve.

redding at 42. you can see the cool air plunging southward. one more system in the pipeline. this one will clip us late tuesday afternoon evening into early wednesday and all signs point toward this would be a weak system by the way. coming in tuesday night and wednesday. after that high pressure builds in. seven and ten day outlooks are correct it will be very warm here. but today mostly sunny. cool and breezy. windy in the hills and along the coast. high 58 to 63. won't matter. everyone will be pretty close here. five day. has nice conditions today. increasing clouds tuesday morning. tuesday night into early wednesday. we'll get more rain. more toward the north bay. it clears out after that. more signs after a cold thursday morning. sunny and warm. european markets are starting the trading week mixed. some gains and losses. overnight markets did post gains with japan leading the

way. knee cay was helped in the rebound by the value of the dollar. it was up more than 1% at the close. checking in on the u.s. market. it does look like a lower opening. lower to start the week. we have not a lot of economic news or earnings reports coming in. we will get a better indication as we get closer to the opening bell. the dow jones at 11, 444. boeing is denying published reports that a dream liner will be delayed again. boeing says it will still deliver the 787 to all airways during the first quarter of next year. boeing says it has a new quarter who is an addition. rub a little salt in the wound. bart will collect on the world series bet. the head of the dallas area rapid system or dart will be say fading hundreds of --

explosion are expected to open this week. claire month and fair month drives could open as early as wednesday. the september 9th explosion created a 72-foot crater. that area is fenced off and patrolled by guards. high enemployment in -- high unemployment in scalds is pushing the further into debt. the state has borrowed $40 million a day to pay unemployment benefits. some of that money will have to be repaid by next september. currently one out of every eight californias is without a job. washington has handed out billions of collar dollars in economic stimulus money. some bay area cities that need the money are not getting it. rio vista for example has not received any stimulus funds. the small town is deeply in

transforted to the hospital we understand is in grave condition. there are no suspects in the case. ktvu kraig debro is on the scene. he's trying to get more information from investigators right now. it has been almost a week since last tuesday's election but two closely watched bay area races remain undecided this morning. ktvu jade hernandez is following the latest results. she's joining us live. she's outside of oakland city hall. we're not sure who will be the mayor. good morning jade. >> reporter: good morning. that is the question. who will be the next mayor of oakland. we may soon find out. we're live at city hall this morning in oakland. gene cain -- quan leeds don crata. for the first time ever they ranked their top three choices. former state senator don

prata's lead was less than 10% when rebeccacap lains votes were recontributed. the county received 122,000 votes by mail and provisional ballots on election day. workers have been sorting and counting furiously. it is supposed to eliminate the run off process. what do oakland voters think in >> i like the ranked voting. it gave me a lot more options. it wasn't a matter of simply picking try to pick one person it was absolutely perfect. >> i think it should just be one or two. not split them and give them a little more here or there. it's not fair. >> reporter: the 11th congressional district seat is also still undecided. only 421 votes separate democrat jerry mcnever my and

harmer. we're live in city hall in oakland. we'll have more on this story straight ahead. 5:32. there is still no winner in attorney general. steve cooley pulling ahead of harris. cooley has 46.1%. harris 45.6%. state election officials say this race may stay too close to call for several more weeks while the mail in provisional and ballots are counting. we will pose the latest election results as soon as we get them in. go to ktvu.com and click on the election 2010 tab. santa cruz police have released a catch of a man trying to sexually assault a teenage girl. he's between 27 and 33 years

old. he's 5'9" weighing 150 pounds. the suspect trying to attack a 15-year-old girl in ocean view park but she managed to get away. oakland police are investigating a motive in the -- the victims were attacked while sitting in a car on eighth street saturday afternoon. one victim was a 17-year-old from hayward. the other victim an 18-year-old from east oakland. police say they were shot from someone outside of the car and died at the scene. >> it's not right. it's not right at all. all these people around here and nobody seen nothing. that is not right. >> police say the car was not registered to eating shooting victim. so far no arrests have been made. fremont police want your help this morning. they are trying to find a hit and run driver that struck an 83-year-old man.

was at a crosswalk friday morning when he was hit. police say the suspect was in a light color 1995 toyota avlon. if you have any information contact fremont police. also officials at an english language school are grieving this morning about the death of a foreign student during a trip to disney land. the van was carrying seven students from an english language center when it overturned. a woman from saudi arabia was killed. two students with head injuries were air lifted to hospitals. the driver apparently dozed off when he opened his eyes he over created and officials say the van flipped over. former bart police officer johannes mehserle remains in the county jail. on friday a judge in los angeles sentence the him to two years in prison. ktvu claudine wong joins us now

from our newsroom. she's been following the story. what is next? >> we are taking a look at a few think thing -- a few thing ifsen you have this bail hearing which is just a couple of weeks away. with this two year sentence it is likely the former bart officer will spend about seven more months behind bars. because he gets credit for what he served. it's unclear where he will serve that time it could be in state or county jail. we know his attorney is already promising to file an appeal on his involuntary manslaughter conviction and his attorney asked that mehserle be freed on bail during that appeal. the district attorney office says it's still weighing its legal options. this morning we also suspect

stores in downtown oakland to reopen since friday. they closed down for fear of what they could do. damage was not as severe as it was after the verdict in july. now some protestors are criticizing the police response saying it ignited unnecessary confrontation. >> in time it will heal. as of now, the wound is wide open. you can't put a band aid on the situation. we can only heal together. i'm here to pray for that right now. >> reporter: meantime religious leaders are trying to turn it into a positive source of change. they are trying to get the justice department to take on the case. and bart while it had no legal position in the criminal case is dealing with civil suits.

peninsula on 101. this would be southbound 101 on whipple. the crash is blocking the two lanes now. the traffic will be very busy this morning as ewe drive down past that area. however if you're driving on highway 280 you can avoid the whole thing and not really worry about it. let's go outside and take a look at what we have now with a look at the san mateo bridge. you may consider staying on '92 and heading south on 280. this is a look at highway 4 westbound coming up to the willow pass grade. so far a nice start. it is 5:39 let's go to steve. thank you. a very good morning everybody. now first things first. it's not cold, cold but ladies, i'm just letting you know it's chilly out there. coldest we've had in awhile. upper 30s. it will be sunny. the days are short now.

we can't get very warm now. the long-range outlook the seven and ten day shows warm weather for us. sunny cool and breezy. see how everything is carving itself out. the drier air is in place. not before decent totals. let me add a couple of these. davenport had an inch and a third. ben had almost two inches of rain. russian river two and a quarter. usually the leader of the pack. san francisco 1.34. he has three gauges. all three came in at that. oakland one and a quarter. red wood city had third of an inch. so not bad. pretty good north bay and down to oakland. after that it fizzled out. sunny but cool and breezy. 50s 60s and 60s. 43 livermore and concord. still going down.

the shooting victim is reportedly in grave condition. johannes mehserle remains in jail. the former bart officer will stay there until his bail hearing. a judge in los angeles sentenced maine ily to two years in prison. president obama is on the final day of his -- indian parliament. president obama said he supports indias push for a permanent seat on the united nations security council. eruptions from mount merapi will not interrupt his plans. you can see people running for their lives. many international flights were canceled. winds are moving the ash away from the capitol.

the volcano has killed more than 140 people since eruptions began last month. areignment is scheduled today for a richmond woman for abandoning her 18-month-old son. her son was found last wednesday. investigators say the mother told them she was not fit to care for her son. the little boy is in protective custody. a man accused of brutally attacking an elderly woman three years ago is due in court today. they will select a jury in the case of jose perez gonzalez. he's accused of robbing an elderly woman and beating her with a crowbar. palo alto could become the cond city in america to require a new type of smoke

alarm. they will require the fire marshals request to require photo electric testers. he says they are far more -- however the new photo electrickic alarms cost more. if they are approved palo alto would require -- muni is addressing a reoccurring problem with its trains. muni has been experiencing 12 mechanical malfunctions a month which adds to a number of delays. muni says the three main causes have been software. digital sensors and disruption. muni says it has been fixing the problems and commuters should see train service in the coming months. as we go to sal i want to send a thank you out to fire station number one. >> that is downtown?

>> yeah. they hosted a tour of the station and a lunch for a fundraiser for our school on saturday. it was so fun. it was very informative. i want to say thank you. they even had a couple of guys slide down the pole. my kids wanted to do it. but it's dangerous. you can take the tour. they won't let you go down the pole. >> good morning everybody. i want you to know. i've seen that fire station. let's go outside and take a look at what we have now. southbound 101 whipple avenue. the traffic is still slowing down because of an earlier crash. this crash was blocking the two left lanes. sounds like they are making progress on that crash if you are driving on the peninsula. i think you should use interstate 280 instead. 280 instead of 101. let's go to another live picture. if you are driving out to highway 101 and you want to head south i think the best

kentfield had an inch and a half. santa cruz mountains had 1-2. sunny but cool and breezy. 50s and 60s. that is it. we're already at 39. 43 livermore and concord. temperatures are going down. if the wind is calm. 20s up in the mountains. 37 ukiah. there is cool air there. remember last week they had 100- degree temperatures. that will not be the case this week. you can see one more little system coming down. it will be weaker. it is a fast mover. it's not nearly as strong. it will clip us and fall apart south of san francisco. it will still make it. after that all signs point toward sunny. everything goes into the middle of the country after tomorrow.

childrens experience results. and comedy is the big draw at the weekend box office. the animated feature mega mind trying to take over the world. tina fey and brad pitt lend their voice. 5:51 san francisco's health kept doesn't have enough food inspectors to check the facilities in the city. the health department has 19 trained inspectors right now. there is supposed to be 23. twice a year health inspections are required in san francisco but that staffing shortage means some restaurants are only inspected once a year. money problems for a bay area airport. apparently even airports have to hope the banks will lend them money. and she is the new queen of facebook. who will be her friend?
